We at Subatomic Show Control and any of our affiliate companies, (collectively, “Company,” “we,” “our,” or “us”) take your privacy seriously and are committed to protecting it through our compliance with the terms outlined in this Privacy Notice (the “Notice”).  This Notice describes the types of information we may collect from you or that you may provide when you visit the website https://www.subatomicshowcontrol.com, and/or use any of our software running on the website and/or any of our apps or applications (collectively, the “Website”) and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy does not apply to information collected by:

·  Us offline or through any other means, including emails, PayPal, surveys, telephone calls, video calls, in-person, or on any other website operated by the Company or any third party; or

·  Any third party, including through any application or content (including advertising and payment processing) that may link to or be accessible from or on the Website.

Please read this Notice carefully to understand our practices regarding your information and how we handle it.  If you do not agree with our practices, your choice is not to use our Website.  By accessing or using this Website, you agree to this Notice, the Website Terms of Use, and any other policies detailed on the Website.  This Notice may change from time to time.  Your continued use of this Website after we make changes is deemed to be acceptance of those changes, so please check the Notice periodically for updates.  Any terms we use in this Notice without defining them have the definitions given to them in the Terms of Use.

While we have organizational and technical processes and procedures in place to protect your personal information, no electronic transmission over the internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information.  Continue reading about what we do with your Personal Information.

We do not knowingly collect personal information from children under 18 through our Website.  

Types of Information Collected

1. Personal Information

Our Website is configured to be an informational website only.  We do not actively collect any Personal Information through the Website.  In this context, Personal Information includes any data that identifies, relates to, or could reasonably be linked to you or your household, directly or indirectly.

  

2.     Automatically as You Navigate the Website (log files, cookies, and other technologies)

While our Website currently does not collect any Aggregated Data (defined as follows), we may choose to do so in the future and, if so, the following information then would apply. 

When you use or visit the Website, we may automatically record and store certain information in log files.  Generally, we use this information in an aggregated and anonymized way (“Aggregated Data”).  If we need to combine this type of information with Personal Information, we treat it as Personal Information.  Automatically collected information includes statistical or technical information such as your Internet Protocol address, operating system, time, and date, and how you navigate the Website.

On our Website, we may, depending on your cookie preferences, also collect information through the use of "Cookies" or similar tracking technologies, which are identifiers transferred to your browser. We use first- and third-party Cookies to help our websites work, provide you with relevant content and to improve our Website.  Cookies are files with a small amount of data which may include an anonymous unique identifier.  Cookies are sent to your browser from a website and stored on your device.  Other tracking technologies also may be used such as beacons, tags, and scripts to collect and track information and to improve and analyze the Website.

You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent.  However, if you do not accept cookies, you may not be able to use some portions of our Website.

As is true of most websites, we may gather certain information automatically and store it in log files.  This information includes internet protocol (“IP”) addresses, browser type, internet service provider (“ISP”), referring/exit pages, operating system, date/time stamp, and clickstream data.  This information is used to analyze trends, administer the Website, track users’ movements around the Website and gather demographic information about the user base as a whole.  Except as noted herein, this automatically-collected data is not linked to Personal Information.

Each user’s IP address may be logged with each visit and each action performed on the Website.  This information is never provided to third parties, except as otherwise stated in this Privacy Notice, and is logged in only for a temporary period.  IP address information is linked to Personal Information and may be used to block a “banned” user from accessing the Website.

We also may work with third parties to manage our advertising on other websites.  Our third-party advertising partners may use cookies or similar technologies on our and other sites to provide advertising to you based upon your browsing activities and interests, or to display ads that link back to our Website.  If you wish to opt out of interest-based or retargeted advertising, follow the instructions at the bottom of any emails to unsubscribe.

3.     Email and Your Choices

If you have provided us with your contact information, we may use this information to communicate with you about your order, membership, payment, and/or account, or to address and answer your questions.  If you have given us consent by providing your contact information to us, we may, subject to your marketing preferences, send to you education, marketing, product/service support, and research emails/surveys.  Our third-party mail service provider provides us with anonymized and aggregated information about the respondents to our emails.  You can unsubscribe from our marketing and research emails anytime by following the instructions included in them.  We may track open rates for our emails so we can improve our communications with you and our services.  If you participate in our optional surveys, information you provide to us, including Personal Information, may be linked with your Account.  We will not share the Personal Information you provide through a contest or survey with third parties unless we give you prior notice and choice.  Some of our Services may include links to third party websites or apps.  We are not responsible for such websites.  These sites may have their own privacy policies and practices.

4.     Social Media & Contests

We have or may have a presence on various social media platforms, such as Facebook®, Instagram®, Threads®, Twitter® (or “X”).  We may receive anonymized and aggregated demographic and use information from these services when you engage with us on them.  In addition, we may offer sharing features and other integrated tools (such as the Facebook® “Like” button).  Such integrated features may share data and are governed by the privacy policies of the third parties that provide these features.  From time to time, we may conduct contests and sweepstakes.  If you participate, we may collect information from you, as described in the terms of the contest or sweepstakes.

How We Use This Information

We use information that we collect about you or that you provide to us as described throughout this Notice, including to:

                Operate, maintain, and improve the Website;

                Assist those who help us in designing, analyzing, and operating the Website;

                Carry out our obligations and enforce our rights, and protect against fraud, unauthorized or illegal activity, or policy or billing violations; and

                In any other way we may describe when you provide the information, with your consent or the consent of a parent or legal guardian.

 

Accessing Your Information, Your Rights, Opt-Out Rights

Upon request, we will provide you with information about whether we hold any of your Personal Information.  You can contact us at subatomicshowcontrol@gmail.com or through the contact information provided below to correct, modify, request a copy of, or request deletion of this Personal Information or your Account.

We will use commercially reasonable efforts to respond to your request within 30-days unless such request is unreasonable under or would violate applicable law.  If you request to delete Personal Information, you may no longer be able to use some features of the Website.

We will retain information for as long as you are utilizing our products and services or as necessary to provide services to you.  We may also be required to keep some of your Personal Information for legal reasons, for instance to comply with statutory retention periods or for tax purposes.  In addition, we will continue to retain and use Aggregate Data.

OPT-OUT RIGHTS.  We offer certain choices about how we communicate with you and what information we obtain.

•       You may opt-out of receiving emails at any time by clicking “unsubscribe” in those emails.

•       You can delete cookies on your browser.

o   To opt-out of all or some communications from us;

o   To request that we delete any Personal Information that we have stored on you;

o   To opt-out of our sharing your Personal Information with third parties;

o   To request that we limit the use and disclosure of sensitive personal information;

o   To request access to information related to automated decision making; and

o   To opt-out of automated decision making.

 

To exercise any of these opt-out rights via email, you must put “Opt-Out Rights” in the subject line of your email for these communications and include your name, address, and email address in the email along with an explanation of which right(s) you are exercising.  We reserve the right to ask for additional information to confirm your identity before disclosing any Personal Information with you.

Additionally, information is provided for residents of certain states below in the section entitles “California, Nevada and Other States Privacy Rights.”

Security

We take reasonable precautions to protect your data.  Although we endeavor to provide reasonable security, no system can prevent all potential breaches or guarantee perfect security.  Please contact us immediately at subatomicshowcontrol@gmail.com if you suspect a vulnerability in our systems, products, or services.

California, Nevada, and Other States Privacy Rights

Our Website is available to residents in all fifty states.  We recognize that the privacy laws of the various states are changing constantly.  While we endeavor to keep current on the laws of individual states, the information in this Notice is current as of the date on the Notice. 

The following information and terms in this California, Nevada, and Other States Privacy Rights section supplements the information and terms contained in the rest of this Privacy Notice.  It is intended to comply with the laws in those states.  However, we do not distinguish between information gathered from residents of different states and we treat information that we collect from you according to the terms in this section even if you live outside of California and Nevada.     We adopt these terms to comply with the California Consumer Privacy Act of 2018, the amendments to that Act codified in the California Privacy Rights Act, and the Nevada Senate Bill 220, and other state privacy laws, updates, and amendments (all such laws are collectively referred to for purposes of this Privacy Notice as the “CCPA”).  Any terms defined in the CCPA have the same meaning when used in this section of this Privacy Notice. 

While we do not actively collect any Personal Information through the Website, this section provides the information that California and other states require in case we did, or will at a future time, collect Personal Information.  In short, and as more fully explained below, you would have the following rights:

·  The right to request that we delete Personal Information collected from you;

·  The right to know what Personal Information we have collected about you and how it is used and shared;

·  The right to opt-out of the sale and sharing of your Personal Information;

You may request a list of all third parties to which we have disclosed your Personal Information during the preceding year for the third parties' direct marketing purposes by sending an email to subatomicshowcontrol@gmail.com.  For all requests, you must put the statement "Your Privacy Rights" in the subject line and body of your request, as well as your full legal name, street address, city, state, zip code and the email address that we have on file for you.  We reserve the right to ask for additional information to confirm your identity prior to responding to any request.  Please note that we will not accept requests via the telephone or by facsimile, and we are not responsible for notices that are not labeled or sent properly, or that do not have complete information.

"Do Not Track" Signals:  We do not support Do Not Track ("DNT").  Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked.  You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser.

In additional to the information defined in other sections of this Privacy Notice, we may collect information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device (also included within “Personal Information”).  We have collected or may collect the following categories of personal information from consumers within the last twelve (12) months:

·  Inferences drawn from personal information:  No.

Personal information does not include:

·               Publicly available information from government records.

·               De-identified or aggregated consumer information.

·               Information excluded from the CCPA's scope, like: health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data; personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver's Privacy Protection Act of 1994.

For purposes of the CCPA, we do not “sell” personal information, nor do we have actual knowledge of any “sale” of personal information of minors under 16 years of age, as the term “sell” is commonly understood.  That said, we may share information with third-party advertising partners or analytics providers for the purpose of promoting our Website as described above, including for cross-context behavioral advertising.  To the extent that such sharing is considered a “sale” under the CCPA, you may opt-out of having your personal information shared with such advertising partners or analytics providers by following the instructions found below.

The CCPA provides consumers with specific rights regarding their personal information.  This section describes your CCPA rights and explains how to exercise those rights.

Access to Specific Information and Data Portability Rights:  You have the right to request that we disclose certain information to you about our collection and use of your Personal Information over the past 12 months.  Once we receive and confirm your verifiable consumer request, we will disclose to you:

·               The categories of sources for the Personal Information we collected about you.

·               Our business or commercial purpose for collecting or selling that Personal Information.

·               The categories of third parties with whom we shared that Personal Information.

·               The specific pieces of Personal Information we collected about you (also called a data portability request).

·               If we sold or disclosed your Personal Information for a business purpose, two separate lists disclosing:

o   sales, identifying the Personal Information categories that each category of recipient purchased; and

o   disclosures for a business purpose, identifying the Personal Information categories that each category of recipient obtained.

Deletion Request Rights:  You have the right to request that we delete any of your Personal Information that we collected from you and retained, subject to certain exceptions.  Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your Personal Information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service providers to:

·               Complete the transaction for which we collected the Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.

·               Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.

·               Debug products to identify and repair errors that impair existing intended functionality.

·               Exercise free speech and/or ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.

·               Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).

·               Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.

·               Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.

·               Comply with a legal obligation.

·               Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Correction of Inaccurate Personal Information:  You have the right to request that we correct any inaccurate Personal Information that we have related to you.  Once we receive and confirm your verifiable consumer request, we will correct (and request our service providers to correct) your Personal Information in our records, unless an exception applies.

Sensitive Personal Information:  You have the right to limit our use and disclosure of Sensitive Personal Information.  Sensitive Personal Information is a specific subset of personal information that includes certain government identifiers (such as social security numbers); an account log-in, financial account, debit card, or credit card number with any required security code, password, or credentials allowing access to an account; precise geolocation; contents of mail, email, and text messages; genetic data; biometric information processed to identify a consumer; information concerning a consumer’s health, sex life, or sexual orientation; or information about racial or ethnic origin, religious or philosophical beliefs, or union membership. You may request that we limit our use and disclosure of Sensitive Personal Information by sending a verifiable consumer request to us as outlined below.

Only you (or a person registered with the Secretary of State of your state of residence that you authorize to act on your behalf) may make a verifiable consumer request related to your Personal Information.  You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period.  The verifiable consumer request must: (i) provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative; and (ii) describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.  Making a verifiable consumer request does not require you to create an account with us.  We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

Personal Information Sales Opt-Out and Opt-In Rights:  If you are 16 years of age or older, you have the right to direct us to not sell your Personal Information at any time (the "right to opt-out").  We do not sell the personal information of consumers we know are less than 16 years of age, unless we receive affirmative authorization (the "right to opt-in") from either the consumer who is between 13 and 16 years of age, or the parent or guardian of a consumer less than 13 years of age.  Consumers who opt-in to Personal Information sales may opt-out of future sales at any time.

Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize personal information sales.  However, you may change your mind and opt back into Personal Information sales at any time by contacting us as provided above.

You do not need to create an account with us to exercise your opt-out rights.  We will only use Personal Information provided in an opt-out request to review and comply with the request.

Response Timing and Format:  We endeavor to respond to a verifiable consumer request within 30 days of its receipt.  If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.  If you have an account with us, we reserve the right to deliver our written response to that account.  If you do not have an account with us, we will deliver our written response by mail or electronically, at your option (if no preference is indicated we reserve the right to contact you at our discretion).  Any disclosures we provide will only cover the 12-month period preceding the receipt date of the verifiable consumer request.  The response we provide will also explain the reasons we cannot comply with a request, if applicable.  For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded.  If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Non-Discrimination:  We will not discriminate against you for exercising any of your rights as outlined in this section.  Unless permitted by the CCPA, we will not:

·               Deny you goods or services.

·               Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.

·               Provide you with a different level or quality of goods or services.

·               Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
